Requiem Service: Terms of Service

The purpose of these Terms of Service is to define basic matters and other general matters regarding service use between a game user (“user” or “you”) who intends to use the Requiem online service (“the service”) of Gravity Co., Ltd. ("the company") and the company.

You are not allowed to use the service without agreeing to these terms; it should be noted that you are considered to give your approval of these terms by using the service.

If you do not agree with these terms, you are supposed to close the current web page, and you must not create your account or use the service.

This service is provided for users that are over 18.

Article 1 [Effect and Amendment of these Terms of Service]

1. These terms are officially announced on the online homepage, and become effective when you select the “I agree to the terms” box upon the creation of your account.
2. You are considered to signify that you agree to visit the homepage on a regular basis to check any amendments of the terms. The company is not liable for damage that occurs due to your ignorance of the amendments to the terms.
3. These terms are subject to change under reasonable circumstances. Altered terms are announced on the homepage Notice Board, and become effective at the date of application.
4. You have the right to disagree with altered terms, and may cease using the service and withdraw as a member. It should be noted that you are considered to agree to the altered terms if you continue using the service after notification of the modification is posted or sent.

Article 2 [Duties of Users]

1. In regards to names or titles that you select for yourself, such as your account name and character name, the following cases are not allowed to be used.
   1. A name that represents or may represent you falsely as a Game Master
   2. A name that is used with the intention of impersonating another person
   3. A name that includes abusive language or vulgarity, may defame another’s reputation, is indecent or obscene, or is derogative against a race, nationality, etc.
   4. A name that consists of a trademark or registered trademark of the company or another company
   5. A name that infringes on another’s right without permission
   6. A name of a person engaged in pop culture or media
   7. A name of a god or religious figure
   8. A name that contains a narcotic drug name, or is related to drug use, opium, or criminal acts.
2. You have the responsibility of protecting your account and passwords from not being disclosed to others.
3. You must not use another user’s personal information or account for inappropriate purposes.
4. You must not be engaged in the following cases, either verbally or behaviorally.
   1. Presenting a film, contents, or language considered as obscene by socially common opinion
   2. Presenting a film, contents, or language considered as obscene by socially common opinion
   3. Presenting contents or language considered as illegal, harmful, threatening, cruel, distressing, defaming, ribald, obscene, hateful, or provoking antipathy in a racial, national, or another similar base.
   4. Using a misspelled or alternate letter to avoid language limitations.
   5. Making a chatting screen change too fast to keep up with the speed for others, or using a macro which contains too many texts.
   6. Misrepresenting yourself as a Game Master, employee of the company, or another person
   7. Collecting, transmitting, or posting personal information of other users while playing the Requiem Online game, or on a related web site or web board through bots or other automation technologies
   8. Scheming or instigating a criminal act
   9. Causing another user to suffer by fraudulently taking his or her weapon, arms, or any another items attained in the normal course of game playing.
   10. Causing inconvenience to another user by harassment or threats, or constantly troubling a specified user while using the service
   11. Altering a game client program, hacking a game server, or changing the homepage partially or totally at your own discretion
   12. Copying service content or information for purposes other than using the service without the prior consent of the company, using this information for publishing or broadcasting purposes, or providing it to a third party.
   13. Modifying or copying a character or item data
   14. Advertising or promoting a product of another company while using the service
   15. Selling pirated software while using the service or using the service for any other illegal purpose
   16. Exchanging private information or information in violation of the privacy protection rules applied in society while using the service
   17. Setting up a group based on social bias such as race, gender, a particular religion, or fanaticism while using the service
   18. Intentionally misusing a program bug while using the service
   19. Distributing the intellectual property of the company or a third party without prior consent while using the service
5. You cannot claim ownership of service contents; you acquire the right of use by signifying your consent to the terms. In other words, you are not allowed to sell, transfer, share, donate, or mortgage what you achieve, such as an item and a character, through using your account or the service.
6. You shall frequently check the notices and operation policies posted on the homepage and follow them for smooth operation of the game.

Article 3 [Creating an Account for Using the Service]

1. To use the service, you shall create your own account (“account”), and you should be over 18. Only a person is allowed to create an account; that is, a company, limited liability company, association, or corporation in any other form is not allowed to do so.
2. To create an account, you shall provide personal information such as your name, gender, and country of residence to the company. It is required to submit precise and up-to-date information to the company since such information is used for user identification in providing service.
3. You shall provide your e-mail address when creating an account. The company has no responsibility for cases in which your service use is limited because the company fails to contact you due to a situation caused by you (e.g. providing an incorrect e-mail address) when a problem occurs in your service upon the creation of your account or afterwards.
4. Your service use is always limited by the conditions and limitations set by these terms, and you are not allowed to share your account with others.

Article 4 [Security of Account and Passwords]

1. The company may require you to change your passwords for emergent security purposes. In such cases, you shall change the passwords of your account upon the first log-in after the request.
2. You have the responsibility of managing your account and passwords. You bear the responsibility for damage in your service use and abuse by third parties caused by your negligence; the company does not have any responsibility for such situations.
3. You shall notify the company of the misuses of your account and other security-related violations immediately after you find out about them.
4. In cases in which your account is stolen, hacked, or damaged by any other reason, and you report the problem, the company temporarily suspends your account until the investigation of the reported problem is finished. This measure is taken to protect your account data, including characters and items. After the investigation is finished, the company decides how to deal with the problem.
5. In cases in which your account is stolen, hacked, or damaged due to a deliberate offence or serious mistake by the company, the company shall restore your damaged game data within the limits of the relevant technology, or compensates you with the corresponding game time. The company does not have the responsibility to offer you monetary compensation or monetary rights unless a judiciary authority gives an order to do so.
6. Despite the provisions mentioned above, in cases in which your account is stolen, hacked, or damaged due to your sharing of your account with a third party due to neglecting the terms mentioned above, the company does not have any responsibility for such situations.

Article 5 [Termination of Service Use]

The company considers you to have ceased using the service if you meet the following conditions and do not play the game. In such a case, the company may delete your account with prior notice, or modify or delete game-related information from your account. In cases in which you have Gravity Points charged, the period is calculated from the point of time when your points are expired.

• A character that is less than Level 30 of the account has not been used for the last 3 months.
• An account that has not been used for a year after registration.
• An account that has not been used for a year since the last log-in date

Article 6 [Violation of Duties]

In cases in which you violate the duties mentioned in these terms, the company may take action to limit your service use in accordance with the Company Operation Policy.

Article 7 [Limitations in Service Use]

1. The company has the exclusive right to produce secondary works of authorship based on the service provided to users. In other words, you cannot create secondary works of authorship based on the service without the prior written consent of the company.
2. Only a person authorized by the company has the right to host the service. You are not allowed to host, imitate, change the communication protocol used by the company as a part of the service, or provide war-game service in any form. These banned methods include protocol emulation, tunneling, reverse engineering, client program modification or addition, or uses of a utility program for service hosting.
3. You are not allowed to (i) modify the client or any of its files, or (ii) create or use cheats, mods, hacks or software that alters experience levels.
4. Despite the provisions mentioned above, you may use the service to apply authorized patch files and update files provided by the company.
5. You are not allowed to attack or attempt to confuse the server. It is also prohibited to modify or affect the client software of another user.
6. You must not violate local, national, or international laws whether intentionally or not.

Article 8 [Server Maintenance and Repair, and Service Suspension]

1. The company aims to provide the service 24 hours a day, but may not be able to do so due to inevitable server errors.
2. The company may temporarily cease the service in order to perform required maintenance and repair, replacement, mending, or testing of service-related communication equipment.
3. The company shall notify you of service-related software upgrading, maintenance and repair of servers, and repair and replacement of data transmission cables and any other system through the homepage in advance.

Article 9 [Service Termination]

The company may terminate providing the service under circumstances in which performing the ordinary course of providing the service has been challenged due to poor profitability or other situations experienced by the company. In such cases, the company shall notify you of the specific details through the homepage in advance.

Article 10 [Termination of Contract]

You can terminate the contract at any time you wish to do so. In such cases, you may terminate the contract through the Withdrawal of Membership function on the homepage.

Article 11 [Guidelines for Service Use]

1. Basically, the service provided by the company is free of charge. Specific services may require charges.
2. If you wish to use a pay service, you may do so by charging your Gravity Points.
3. You are not allowed to transfer your Gravity Points to another user or account.
4. The ownership of every item within any of the pay contents or game contents provided by the company is held by the company. The right to use the pay contents in the game is held by the user that purchases the pay contents. Such user has the right to use the pay contents provided by the company while playing the game for a certain period of time, and the transfer or sale of the rights in a way that is not authorized by the company is prohibited.
5. In regards to pay contents that do not have fixed periods of use, you may use the contents until the termination of the service from the date of purchase. In regards to pay contents with fixed periods of use, you may use the service until the expiration date clarified on the date of purchase.
6. In regards to pay contents without fixed periods of use, the right of use is ensured in the condition of normal service use. If you violate these Terms of Service, and your account use becomes limited as a result, you cannot use the pay contents and the company does not owe the responsibility to return the money you paid.
7. In cases in which the service is terminated due to situations experienced by the company, the money you paid for pay contents without fixed period of use is partially refunded if you paid for the pay contents less than a year before. The amount refunded in this case is calculated by subtracting total number of days the item has been owned from the total number of days in a year (365 days in a year), and then multiplied by the pay content’s service charge for a day. (service charge for a day = purchase price/365)). The money you paid for pay contents with a fixed period of use is refunded for the unused remaining days.
8. In cases in which pay contents are deleted during the operation of contents for game planning or operational purposes, you will be notified 7 days before implementation on the homepage Notice Board, and the remaining amount of money is refunded as Gravity Points in accordance with the previous item.
9. Pay contents provided free of charge to you are not eligible for refund or compensation.
10. In regards to pay contents, the cancellation of the subscription of the following contents is not allowed; that is, cancellation or refunds is not applicable for the following.
    • Avatars or ornamental items
    • Game items

Article 12 [Use and Deduction of Gravity Points]

1. Gravity Points are used to purchase pay services or pay contents, and the corresponding amount of money is deducted immediately upon these purchases.
2. In the event that pay contents purchased by Gravity Points are damaged, destroyed, lost, or deleted due to situations caused by the company, the company shall restore the pay contents. If restoration is not applicable, then the company shall charge the corresponding amount of Gravity Points to your account.
3. Income from interests for the remaining amount of money charged as Gravity Points dose not accrue.

Article 13 [Expiration of Gravity Point]

You can terminate the contract at any time you wish to do so. In such cases, you may terminate the contract through the Withdrawal of Membership function on the homepage.

Article 14 [Refunds]

1. Your Gravity Points shall be refunded in accordance with the following rules in cases in which you request a refund, cancellation, or termination of the contract.
   1. Refund of your Gravity Points is limited to the total remaining amount.
   2. In cases in which you request to cancel subscription of points within 7 days from the charging date of Gravity Points, the total charged amount of money will be refunded without imposing a refunding commission and additionally remittance charge shall be deducted from the amount.
   3. In cases in which the company is given all information necessary for contract termination, cancellation of subscription, and refund, the company shall refund the money to you in the same way as your payment within 10 days from the date of receiving all relevant information from you. If it is impossible to refund the money in the same way as your payment, the company shall notify you of the fact in advance.
2. In the following cases, refunding or cancellation is not applicable.
   1. In case in which a total refund amount is less than remittance charge, a refund is not applicable.
   2. Gravity Points charged through a prepaid card are not refunded.
   3. Contents or cash given by the company free of charge is not refunded.
   4. The period of account suspension due to your violation of the terms is not counted in the term of repayment.

Article 15 [Compensation for Damages]

1. In cases in which the service ceases for more than 4 hours (accumulated time) a day due to a situation caused by the company, and you are a user of a pay service that has fixed time of use, the company compensates you with threefold of the ceasing time of use. It should be noted that service suspension notified in advance for regular inspection or any other relevant reason is not eligible for this compensation.
2. The time of service suspension mentioned in the previous item is counted from the time you report it to the company. Service suspension time related to inevitable circumstances such as natural disasters or pre-informed situations including circuit installation, power stoppages, and regular inspection is not counted.
3. The account suspension time related to your violation of the Terms of Service is not considered for compensation.
4. In cases in which you cause damage to the company by violating the Terms of Service or using the service, you shall compensate the company for such damages.
5. Services that are free of charge are not eligible for compensation.

Article 16 [Exemption]

1. The company does not have responsibility for troubles in service use caused by your fault.
2. The company is discharged from responsibility for damage that occurred from inevitable reasons such as pre-notified service facility repair, replacement, regular inspection, and construction.
3. The company is not bound to be engaged in conflicts between users, or a user and a third party. The company is not responsible for damage related to such conflicts.

Article 17 [Jurisdiction and Standard Laws]

In the case of a conflict related to these terms, the conflict shall be solved by entering into an agreement between the concerned parties. If the parties in question fail to reach an agreement and a lawsuit is started, then the relevant laws of the Republic of Korea apply to the lawsuit between the company and a user.
